Terms & Conditions

These Terms are the agreement between you and Screwcap Games, LLC (“Screwcap”, “we”, “us”) covering Sutda — the site, the game and everything in it. By playing, you accept them. They sit alongside the Screwcap Games master terms: where this page is more specific it governs for Sutda.

1. This is not gambling

Sutda is modelled on a game that is traditionally played for money. This version is not. All stakes, chips and balances are virtual, have no monetary value, and cannot be bought, cashed out, exchanged or transferred to anyone, including us. There is no wagering of real money and no prize of real value. Nothing you win here can leave here.

If your jurisdiction takes a different view of simulated card games than we do, its view wins and you should not play. We would rather say that plainly than bury it.

2. Who may play

You must be 13 or older. If you are under the age of majority where you live, you need a parent or guardian’s permission. Don’t use the game if a law where you are says you may not.

3. Your licence, and its limits

We grant you a personal, revocable, non-transferable licence to play Sutda for your own non-commercial enjoyment. Everything in it — code, art, audio, characters, text, the name and the look — stays ours or our licensors’.

You agree not to: copy, reskin or redistribute the game or its assets; reverse-engineer it except where law says you may; strip, hide or spoof the ads or any paywall; automate, scrape or hammer it; or present it as your own. Fan art, streams, videos and reviews are welcome and always were — credit us and link back.

4. Virtual items and purchases

Any unlock you buy is a licence to a feature, not property you own. It is version-scoped and stored in your own browser, which has one consequence worth stating loudly: clearing your browser data destroys it and we cannot restore what we cannot reach. Keep the receipt and the licence key.

Payments are handled by our merchant of record, not by us; we never see your card. Refunds are covered by our published refund policy and by whatever your local consumer law grants you, which we are not trying to talk you out of.

5. Availability

The game is provided as-is and as-available. We may change, suspend or retire it, or any part of it, at any time. We have retired a game before and redirected it rather than deleting it, and that is our intention if it happens again — but we do not promise perpetual availability of anything, and you should not build a habit that assumes it.

6. Disclaimers

To the fullest extent the law allows, the game is provided without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that it will be uninterrupted, error-free, or that any historical data in it is complete or accurate.

7. Limitation of liability

To the fullest extent the law allows, neither we nor our licensors are liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill. Our total liability for any claim relating to the game will not exceed the greater of what you paid us in the prior twelve months or USD $50. Some jurisdictions do not allow these exclusions, in which case they apply only as far as they legally can.

8. Indemnification

You agree to defend, indemnify and hold us harmless from claims, losses and reasonable legal fees arising out of your use of the game, your breach of these Terms, or your violation of any law or third-party right.

9. Governing law and disputes

These Terms are governed by the laws of the State of Wisconsin, USA, without regard to conflict-of-laws rules, and any dispute is subject to the exclusive jurisdiction of the state and federal courts in Walworth County, Wisconsin. If any provision is held unenforceable, the rest stays in force.

10. Privacy

What we collect and every outside tool we run is set out in the Sutda Privacy Policy, which forms part of these Terms.

11. Changes

We may update these Terms; material changes move the date at the top. Continuing to play after a change means you accept it. We will not email you a novel about it.
